The Position:Position Purpose
The Labor Relations and Compliance Specialist is a confidential position reporting to the Chief Human Resources Officer or designee. The incumbent independently performs a wide variety of complex and analytical duties in support of Title 5, the Educational Employment Relations Act, Californias Equity in Education Act, California Community College EEO Plan program, the Violence Against Women Act, Labor-Code Mandated Workplace Violence Prevention and Employee Relations; provides analysis and support for investigations of complaints alleging violations of policies impacting employer/employee or student/employee relationships including prohibiting harassment and discrimination on the basis of a protected class, workplace violence, and assist with mediation or conflict resolution. The incumbent may be assigned to the regulatory areas of Recruitment and Training, Employee Relations, Title 5 or Title I and Title II ADA/ADAAA.
General Description
The Labor Relations and Compliance Specialist performs a variety of advanced administrative and compliance related duties in support of District, state and federal policies, procedures, laws and requirements pertaining to equal employment opportunity, labor relations, workplace violence prevention program and other employment-related compliance programs. An extensive amount of public contact is required to respond to electronic and in-person inquiries. A high degree of independent judgment and creativity are required to select and apply policies and procedures to the resolution of minor and occasional major problems that arise. The consequences of errors in judgment can be costly in public relations, employee time, resources, and District liability. The Labor Relations and Compliance Specialist is distinguished from the Human Resources Representative position by the nature, responsibility, analysis, complexity, and technicality of the work. A Labor Relations and Compliance Specialist can direct the work of lower level Human Resources staff and student assistants as assigned. The Labor Relations and Compliance Specialist is in the Confidential Unit for collective bargaining.
Duties and Responsibilities:The Duties and Responsibilities are representative and not intended to cover all duties the incumbent may perform. - Administer day-to-day management of complaints and grievances through the case management system to track program compliance from intake to closure.
- Assist facilitation of supportive measures and/or final case resolutions reached following applicable law and policy.
- Participate in the development of the annual EEO Plan development and adoption by the Board of Trustees. Assist in collecting and analyzing data for the Title 5 annual EEO complaints and outcomes report: a component of the annual EEO Report adopted by the Board of Trustees.
- Assist with categorizing and maintaining Workplace Violence Prevention Program report logs and responding to information requests.
- Conduct and assist with the preparation, delivery and publication of mandatory training programs per federal, state and California Community College laws and regulations.
- Collaborates with executive leadership, faculty and staff to identify training needs and tailor programs to the needs and circumstances of the intended audience.
- Ensure relevant and current employment and compliance information, contacts, policies and procedures are included on the appropriate District and college websites and other applicable communication channels.
- Create, update and manage all required annual notices such as the Notice of Non-Discrimination, Drug-Free Campus Notice and Workplace Violence Prevention notice.
- Maintain and manage the Workplace Violence Prevention Plan annual review and plan updates for recommendation to the Chancellor.
- Participate in District or college standing committees, state working groups and organizations to remain current on developments in the field, legal updates and evidenced-based prevention programming.
- May serve in a lead capacity for Title I or Title II ADA grievances and recommend reasonable accommodations. Conduct related training and technical assistance for employees and managers.
- Assists with labor grievances, unfair labor practice charges and EERA information requests.
- Consult with, make recommendations and advise managers and supervisors on the interpretation of technical information and the implication on operations and procedures; identify issues and concerns related to operations, policies and procedures and coordinate the resolution of process-related problems; coordinate project workflow, identify assignments to District and college managers and supervisors and track progress.
- Provide advice and guidance related to employee relations, Title 5, Equity in Education, EERA, Clery, CANRA, ADA and employment-related California Community College regulations.
- Conduct research, perform specialized analyses, to develop statistical and narrative reports as needed.
- Plan and coordinate in-service and external training on subject such as employer-employee relations, Title 5, Equity in Education, the Clery Act, Workplace Violence Prevention related to legal updates, collective bargaining agreement updates, EEO training, and ongoing refresher information for a variety of audiences.
- Identify risks and opportunities and recommend changes to processes that improve the delivery of labor relations, complaint investigations and conflict resolution for the District.
- Partner with leaders across the District to develop and deliver program-related communications.
- Perform other related duties as assigned
- Bachelors degree in human resources, business, public administration, sociology, political science or a closely related field OR an equivalent combination of education and experience
- Successful and recent human resources experience of increasing responsibility in the areas of EEO, Title 5 and regulatory processes and procedures
- Demonstrated cultural competence, sensitivity to, and understanding of the diverse academic, socioeconomic, ethnic, neurodivergent, and LGBTQIA+ backgrounds of community college students, faculty, and staff
